What is collaborative family law?
A relatively new approach to the standard divorce proceedings is to follow a collaborative family law process. Although the end result is similar to that of standard divorce proceedings, the collaborative family law process takes a vastly different approach in reaching the end result. Collaborative law is becoming increasingly popular in Cincinnati and throughout Ohio.
Prior to beginning the collaborative family law process, both parties in the divorce must agree to abide by collaborative regulations. The regulations are in regards to giving an honest attempt at settling everything within the collaborative process. There is to be no threatening of going to divorce court and both sides agree to fully attempt to reconcile all differences without the use of intimidation or coercion of any type.
The conferences in a collaborative family law process usually consist of only four people – the two parties in the divorce and a lawyer for each. No confidential deals can be struck, as everything has to be hashed out in these conferences.
During these conferences, the four attendees are allowed to talk freely. One by one, each issue is brought to the table in which the two sides have a disagreement. The issue is talked about and negotiated until both sides come to an understanding. This continues until all issues have been hammered out and both sides are satisfied with the results.
Compared to traditional divorce proceedings, a collaborative family law process has many advantages.
The major advantage is collaborative family law proceedings take place outside of the courtroom. Since it’s outside of a courtroom, the divorce proceedings remain more private than they would be if held within a courtroom.
Additionally, the costs are generally less when following a collaborative family law process due to the elimination of court fees. Collaborative law attorneys usually don’t receive compensation unless a divorce agreement has been reached, so everyone involved is aiming at the singular goal of overcoming the disagreements.
